Rapid Travel Testing – Terms & Conditions
TERMS & CONDITIONS
1.1. These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (you), and Rapid Travel Testing, located at Registered office: 11 Conway Gardens, Wembley, England, HA9 8TR (we, us), concerning your access to and use of the Rapid Travel Testing www.rapidtraveltesting.co.uk website, any related applications and our testing website.
1.2. These terms cover any testing services or test kits supplied in relation to Covid-19, including but not limited to Covid-19 PCR tests, lateral flow tests, antigen tests and antibody tests.
1.3. You agree that by accessing the website and/or Services, you have read, understood, and agree to be bound by all of these Terms and Conditions.
1.4. If you do not agree with all of these Terms and Conditions, then you are prohibited from using the Site and Services and you must discontinue use immediately. We recommend that you print a copy of these Terms and Conditions for future reference.
We make reasonable efforts to ensure that the content on our site is complete, accurate, and up-to-date. We do not, however, make any representation, warranties or guarantees (whether expressed or implied) that the content on our site constitutes advice on which you should rely. We recommend that you take professional or specialist advice before taking any action relating to the planning or delivery of your diagnosis, treatment or care.
3.1. You promise that all information that you supply to us in connection with your order/booking is accurate and not misleading and that you will tell us if there are any important changes. We take no responsibility for incorrect information on any forms, certificates or results notifications if that information has been supplied by you.
3.2. We may offer discount codes from time to time. Such codes may only be applied to purchases made through the account in respect of which the discount code was offered and registered and are not transferable or redeemable for cash. Unless otherwise stated: codes (a) are only available for future new orders placed online; (b) cannot be used retrospectively; (c) can only be redeemed once per customer; and (d) may expire at any time at our discretion. You cannot use more than one discount code per transaction unless we state otherwise; if we do so, the order in which the codes are to be applied shall be in our sole discretion.
3.3. We reserve the right to reject any discount code if we consider that it is being used in breach of these terms. Discount codes are subject to any additional specific terms and conditions which are specified at the point of issue. We reserve the right to discontinue or otherwise modify any discount codes at any time without prior notice.
4.1. Our tests can only be administered by clinicians at site premises or other locations mentioned on the Rapid Travel Testing website and is otherwise subject to any restrictions we have explained.
4.2. We aim to administer the tests during the time specified at time of booking. We are not responsible for delays in administration of tests (a) if due to circumstances beyond our reasonable control and where we could not have taken reasonable steps to deal with the delay or (b) if you haven’t presented at the test location at the time specified at booking.
4.3. For clinician administered bookings, it is your responsibility to ensure that you and the other people for whom you book tests are all present at the specified test clinic during the time slot and in a position to promptly administer the tests. The clinician is entitled to cancel the booking if within 30 minutes of the allocated time slot you have failed to present for your test.
5.1. For the purposes of this service a ‘result’ is deemed to be:
- Positive – Covid-19 has been detected in the sample at the time of the sample.
- Negative – Covid-19 has not been detected at the time of the sample.
- Inconclusive – Neither a positive nor a negative result has been generated, but instead, an inconclusive result has been produced. Your sample must be re-run as a positive or negative result could not be provided during the first instance.
Please be advised that any of the above outcomes (positive, negative or inconclusive) are deemed to be a ‘result’, and therefore, a refund will not be issued.
5.2. We will take reasonable steps to email, text or upload onto our app that your test results and certificates are available on your patient profile within the agreed timescale as set out on our website. It is your responsibility to contact us promptly if you have not received notification of your results within the expected period. We take no responsibility for early or late test results other than as set out in the Refunds and Cancellations section below.
5.3. You acknowledge that, as with any medical test, 100% accuracy of our tests cannot be guaranteed. For example, there is always a risk of either a “false positive” or a “false negative” test result. Also, there is a risk that the test will not cover a new Covid-19 variant. Accordingly, we are not legally responsible for incorrect test results and you rely on the test results at your own risk.
5.4. We do not take any responsibility or offer any refunds for inconclusive or void test results, including void results due to failure of the test kit that we provide. We may in our discretion offer replacement tests in these cases.
5.5. You acknowledge that in the event that your Covid-19 test has a positive result then, as is required by law pursuant to the Public Health (Control of Disease) Act 1984 and the Health Protection (Notification) Regulations 2010, your test result and personal details, which may include your name, date of birth, gender, home address, telephone number, NHS number, occupation, place of work, ethnicity and the fact that you have tested positive for COVID 19 must be communicated to Public Health England, either directly or by any laboratory that we subcontract.
5.6. You understand that we or any laboratory that we subcontract will be unable to erase your test results, which are required as evidence of clinical practice.
5.7. If your test is processed by a subcontracted laboratory you understand that you have authorised us to order your test on your behalf, and we will be responsible for receiving your results and communicating them to you.
5.8. You understand that your Covid-19 test is to be used for screening purposes only as a convenient and confidential way of getting tested quickly for a Covid-19 infection. The results are not intended to replace medical advice, nor should they be used as a full diagnosis, or to prescribe medication without consulting an appropriate medical professional. You are advised to seek medical advice from your GP if medical advice is required following a positive test.
6.1. All bookings/orders made by you are final. We accept no responsibility for bookings made in error by you or persons on your behalf and no refunds will be administered in the event of your error.
You may cancel your order by contacting us by phone or, if phone is not available, email firstname.lastname@example.org.
6.2. All tests are fully non-refundable due to the nature of the bookings as time slots are limited and once booked can’t be withdrawn, for postal tests once an order is placed the delivery process begins immediately and tests allocated. Please ensure you are booking the correct test for the correct clinic at the time specified. We will however, if an appointment is missed, or a late show, try to accommodate any bookings and it is at the sole discretion of the clinic that this is possible.
Please be advised that We reserve the right to amend the cost of any of its products/services at any given time without prior notice. This will not affect existing bookings.
7.1. Please be advised
- Antibody tests are not PCR tests and do not check for current infections.
- Antibody and PCR tests are medical products/services and cannot be transferred.
- Fit to fly is defined as: Fit to fly certificate that confirms a negative result only confirms that at the time of the test being completed you may have been negative of covid-19; it does not assess any other health or medical conditions.
7.2. It is your sole responsibility to determine what Covid-19 test you need for your travel destination, and when you need to take your test. Any information we may provide in this regard to you over the phone, in writing or on our website is purely advisory and we take no responsibility for the accuracy or completeness of such information.
7.3. You acknowledge that you have made your own independent decision to travel during the Covid-19 pandemic and you are taking the risk that your travel plans may become delayed, cancelled or disrupted if you are not able to produce Covid-19 test results in a timely manner, or in the form required by your destination country. You are strongly advised to take out travel insurance to cover such risk.
7.4. By completing your booking, you give to our laboratory permission to perform the Covid19 test as requested and discharge the laboratory, and its associated companies from any false positives or false negatives that may be identified as a result of any testing, including inconclusive results or samples that have to be re-run.
7.5. Subject to our Refunds and Cancellations policy above, we accept no responsibility or liability for any costs arising from any delay, disruption or cancellation of your travel plans directly or indirectly caused by the requirement to produce a negative Covid-19 test result or travel certificate, even if that delay was caused by us, our delivery service or any laboratory we may subcontract for testing.
If you cancel your appointment or your appointment can not go ahead due to changes in regulations, government policies or changes to airline policies or anything out of our control, a refund will not be possible as our services are non-refundable.
Please be advised that we cannot be held responsible for any financial losses that you may incur as a result of using any of our services, including PCR Travel Testing, and we cannot be held responsible if we have not delivered your result within the given time frames even if there has been human error in obtaining that result. In these cases, our liability to you will be limited to the value of the contract/order, which is the cost of the test you have purchased. If we are not able to deliver the service once a swab has been taken and are in breach of this contract, we will only be responsible for the value of the contract, which is the price of the test. No financial compensation will be offered for any financial or other losses suffered by you.
9.1. Please note that we only provide our Site for domestic and private use. You agree not to use our Site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
9.2. Please note that these Terms and Conditions, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction expect that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland. If you have any complaint or wish to raise a dispute under these Terms and Conditions or otherwise in relation to the Site please follow this link http://ec.europa.eu/odr.
9.3. Nobody else has any rights under this contract. This contract is between you and Rapid Travel Testing. No other person shall have any rights to enforce any of its terms. You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing.
9.4. If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
9.5. You have legal rights in relation to goods that are faulty or not as described. Advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards office. Nothing in these Terms and Conditions will affect these legal rights.
